Terms of participation

Registration, conduct, minors and liability — draft, not reviewed by a lawyer yet.

Draft. This text exists so that registration does not go live without any terms at all. It has not been reviewed by a lawyer. The points that need legal advice before publication are listed at the end.

Note: the German version is the authoritative one, since the event takes place in Austria. This translation is for convenience.

1. Organiser

The UNO tournament is organised by Christian Herkner, Schenk-Danzinger-Gasse 4/3/33, 1220 Vienna (see the imprint). The event is privately organised and non-commercial.

Yella Yella! Nachbar_innentreff, Maria-Tusch-Straße 2/1/5, 1220 Vienna, provides the rooms and is not the organiser.

2. Registration and participation

  • Taking part is free and requires registration through this website.
  • A registration becomes effective with our confirmation email. A place is only secure once that email has arrived.
  • Numbers are limited. Once the tournament is full, registrations automatically join a waiting list; if a place frees up we get in touch in the order of registration.
  • Places are not transferable. If you cannot come, please cancel in good time so somebody else can take the place.
  • Registration closes on the date shown on the front page.

3. Format and rules

The tournament rules apply in the version published on the day of the tournament. Registering means accepting them.

Decisions of the tournament management are final. The management may adjust the format if the number of players or the venue requires it.

4. Conduct on site

  • The house rules of the venue apply.
  • Considerate behaviour is expected, particularly towards children.
  • In cases of harassing, discriminatory or aggressive behaviour, or repeated deliberate breaches of the tournament rules, the management may exclude a person from the event. No compensation arises in that case.

5. Minors

  • Participation is possible from the age of 7.
  • People under 18 are registered by a parent or legal guardian, who expressly confirms consent to participation and to these terms.
  • Children under 12 require an accompanying adult who is present throughout the event. (⚠️ age limit to be decided and reviewed.)
  • From 12, participation without an accompanying adult is possible provided the parent or guardian is reachable by phone during the event.
  • Responsibility for supervision remains with the parents or the accompanying adult. The organiser runs the tournament and does not take on the supervision of individual children.

More on the children & young people page.

6. Liability

⚠️ This is the most important and the most delicate section. Under Austrian law a blanket disclaimer (“participation at your own risk”) is only partly effective: liability for personal injury and for intent or gross negligence cannot be excluded. Please have the wording checked by a lawyer rather than inventing it here.

As a working basis:

  • Participation is at your own responsibility.
  • The organiser is liable in accordance with statutory provisions. Liability for slight negligence causing damage to property is excluded as far as the law allows. (⚠️ to be reviewed)
  • No liability is accepted for belongings brought along. Coats and valuables remain your own responsibility.
  • Participants are themselves liable for damage they cause to others; for minors, the statutory provisions on the duty of supervision apply.
  • The organiser may cancel or postpone the event for good cause (force majeure, official requirements, loss of the venue). Registered participants will be informed; no further claims arise.

7. Photos and video

Photos are taken at the tournament. They are published only with express consent, given separately at registration and revocable at any time. Participation does not depend on that consent. Details in the privacy information.

8. Data protection

How we handle registration data is set out in the privacy information.

9. Changes

These terms may be adjusted until the day of the tournament. The version published here at the time of the tournament applies; for material changes we inform everybody already registered by email.

Please put these points to a lawyer:

  1. Liability wording (section 6) — what may effectively be excluded towards consumers, and what may not?
  2. Supervision and age limits (section 5) — is the limit of 12 appropriate, and how must the handover of supervision be worded?
  3. Exclusion from the tournament (section 4) — conditions and consequences.
  4. Cancellation of the event (section 6) — scope of the exclusion of claims.
  5. Awarding prizes to minors — see prizes.
  6. Consent to photos of children — who may give it, and from what age must the child be asked as well?
  7. Applicable law and place of jurisdiction — should this be regulated at all?
  8. Imprint obligation under § 5 ECG — see the imprint.
